1. Introduction
These Terms and Conditions govern the sale of electronic products by Apicalis Labs ("we", "us", "our") to customers ("you") via our website. By placing an order, you agree to be bound by these terms.
2. Australian Consumer Law (ACL)
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
3. International Orders & Customs
Import Duties/Taxes: When ordering for delivery outside Australia, you are responsible for all import duties, taxes, and customs fees levied by your country.
Compliance: You are responsible for ensuring the electronics you purchase comply with local laws and telecommunications standards in your destination country.
4. Pricing and Payment
Currency: All prices are in AUD unless otherwise stated.
Errors: We reserve the right to cancel orders arising from pricing errors or technical glitches.
Payments: We use secure third-party processors. We do not store your full payment card details.
5. Shipping and Delivery
Risk of Loss: Risk of loss and title for the products pass to you upon our delivery to the carrier (e.g., DHL, Australia Post).
Delivery Times: Estimates are not guarantees. We are not liable for delays caused by customs clearance or international logistics.
6. Warranty and Repairs
For electronic products, the following terms apply:
Manufacturer Warranty: Many products include a manufacturer’s warranty in addition to your ACL rights.
Data Loss Warning: The repair of your goods may result in the loss of user-generated data. We strongly recommend you back up all data (photos, files, software) before returning any device for repair.
Non-Persistent Data: We are not responsible for the loss of any data stored on devices returned for service.
7. Returns and Refunds
Change of Mind: We do not offer refunds for change of mind.
Faulty Goods: Please contact hello@apicalis.com immediately if a product is faulty. We will provide instructions for the return and assessment of the item.
8. Limitation of Liability
To the maximum extent permitted by law:
We are not liable for any indirect, incidental, or consequential damages (including loss of data or profit).
Our total liability to you for any claim arising out of your purchase is limited to the amount paid for the product.
9. Automated Decision-Making
We use automated systems to detect fraudulent transactions and calculate international shipping/tax. We reserve the right to cancel any order flagged as high-risk by our security systems.
10. Governing Law
These terms are governed by the laws of Western Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts in that State.
